Data Request Policy

This Data Request Policy outlines how Webspiders Interweb Pvt. Ltd. (“WIPL”) handles requests for customer data. It applies in conjunction with our Privacy Policy and is incorporated by reference into our Terms of Service.
WIPL respects the privacy and confidentiality of our customers and only discloses customer data as required by applicable laws and legal processes. This policy applies to official requests only and does not govern customer support or billing inquiries.
1. Reference to Privacy Policy
For details on what data WIPL collects, stores, and processes, please refer to our Privacy Policy. This Data Request Policy describes the procedure for submitting formal requests for customer data and WIPL’s obligations in responding to such requests.
2. Types of Data Requests We Accept
WIPL responds to lawful requests submitted in accordance with Indian law. These include:
a) Data Requests
Formal requests for information related to a customer’s account in connection with criminal investigations, civil litigation, or other official legal proceedings. Examples include:

Subpoenas issued by Indian authorities

Court orders

Search warrants
-
Civil investigative demands

Requests originating outside India must be routed through applicable international mechanisms (e.g., Mutual Legal Assistance Treaty – MLAT)
b) Preservation Requests
Requests to preserve customer account data pending receipt of a valid legal process. Preservation requests must:

Identify the account(s) involved (see Section 4)

Be signed on official law enforcement agency letterhead

Confirm that legal steps are being taken to secure access via formal process

Include a valid contact email and phone number
Preserved data will be retained for a maximum of 90 days, unless extended by a valid legal request.
c) Emergency Requests
Accepted only in situations involving imminent risk of serious bodily harm or death. WIPL will evaluate such requests in good faith and respond without delay when justified.
3. Customer Notification
Unless prohibited by applicable law, WIPL’s policy is to notify affected customers when a data request involving their account has been received. Notice may be delayed or withheld if:

A valid court order or statute prevents disclosure

WIPL determines, in its sole discretion, that prior notice would be counterproductive or dangerous
4. Required Information in a Data Request
Each request must include the following:

Full name and contact details of the customer

Registered email address linked to the WIPL account

Domain name and/or IP address associated with the service

Description of the data requested and relevance to the legal matter

A copy of the legal complaint or any supporting documentation (for civil matters)
Incomplete or vague requests may not be processed. WIPL reserves the right to request additional documentation as necessary to verify the legitimacy of the request.
5. How to Submit a Request

IMPORTANT: If you do not receive confirmation of receipt within 5 business days, please resend the request via certified mail or physical courier. Due to spam filters and other email delivery issues, WIPL recommends sending a duplicate physical copy to ensure processing.
6. Processing Fees
WIPL may seek reimbursement of costs in accordance with applicable law. Additional fees may apply for:

Extensive data retrieval efforts

Historical log analysis

Voluminous or complex document production
WIPL reserves the right to deny requests deemed excessive, vague, or outside the scope of relevant legal proceedings.
7. Types of Information Available
Subject to the nature of the legal process and applicable jurisdiction, WIPL may produce the following:
a) Non-Content Information
(With valid legal request)

Subscriber name and email address

Date and time of account creation

Billing and payment records
-
IP login records and access logs
b) Content Information
(Only with valid search warrant)
Includes files hosted on WIPL servers, email content, and website data. Such information is disclosed only upon receipt of a valid Indian court-issued search warrant from a competent authority.
8. International Requests
Requests originating from jurisdictions outside of India must be made through official diplomatic or international legal channels, such as the Mutual Legal Assistance Treaty (MLAT) process. WIPL does not recognize or respond to foreign legal requests submitted directly, without appropriate Indian legal validation.

Policy Updates
